What is a Stipulations With Request For Award
The Stipulations With Request For Award settlement documents must be approved by the Workers’ Compensation Appeals Board (“WCAB”) judge. The judge approves the Stips by signing an order form called a Stipulation With Award (“Stipulated Award”). The parties in the Stips agree to all terms of the settlement.
The judge from the Workers’ Compensation Appeals Board (“WCAB”) has to sign off on the Stipulations With Request For Award settlement documents before they can be finalized. By signing an order form known as a Stipulation With Award, the judge gives the Stips his or her blessing. All of the terms of the settlement have been accepted by the parties involved in the Stips.
Advantages
The biggest benefit of settling by Stips is that the workers' compensation doctor usually agrees to lifetime medical care for industrial body parts/medical conditions (s). The other major benefit of settling by Stips is that the injured worker has the right to file a Petition To Reopen (“PTRO”) the Stipulated Award with the WCAB within five years of the injury for new and further disability if their condition worsens. If the settlement occurs more than five years after injury, the Stips cannot be reopened and the settlement is final as to body parts/medical conditions for future medical care, level of permanent disability, and temporary disability periods. When the injured worker's main concern is lifetime medical care, Stips settlement is often preferred.
Disdvantages
Stipulated Award settlements typically yield less than Compromise and Release settlements. The Stips are not settling future medical costs for a lump sum. An injured worker signs a Stipulated Award knowing that lifetime medical care for industrial body parts/medical conditions is the main benefit. Stipulated Awards keep injured workers in workers' compensation. This means that the right to lifetime future medical care remains open, but treatment may be limited to medical providers in the employer or claims administrator's Medical Provider Network ("MPN"). Utilization Review determines treatment eligibility.
